These General Terms and Conditions (the “Terms”) apply to all sales of timepieces and accessories made through the website david-van-heim.com (the “Site”), a Swiss company based in Geneva. By placing an order, you acknowledge that you have read, understood, and accepted these Terms without reserve.
2. Products and Orders
Availability: All orders are subject to acceptance and availability. David Van Heim reserves the right to modify the assortment of items offered on the Site at any time.
Validation: The contract between you and David Van Heim is finalized only when we send you a confirmation email after the validation of your payment. We reserve the right to cancel any order for legitimate reasons (e.g., pricing error, suspicion of fraud).
3. Pricing and Payment
Currency: Prices are indicated in [CHF/EUR/USD] and exclude customs duties, and shipping taxes unless otherwise stated.
DDU (Delivered Duty Unpaid): For all international orders, you are responsible for paying any import duties and local taxes required by your country’s customs.
Secure Payment: Payments are processed via encrypted third-party providers. David Van Heim does not store your credit card information.
4. Delivery and Transfer of Risk
Shipping: Orders are shipped from our logistics centers in Switzerland. We offer free shipping worldwide via DHL, FedEx, or Swiss Post.
Risk: The risk of loss or damage to the product passes to you upon delivery to the address provided during the checkout process.
5. Intellectual Property
All content on the Site—including designs, logos, photographs, and the “David Van Heim” trademark—is the exclusive property of David Van Heim. Any total or partial reproduction, modification, or use of these elements for any reason is strictly prohibited without our prior written consent.
6. Limitation of Liability
David Van Heim shall not be liable for any indirect or consequential damages arising from the use of the Site or the purchase of a product. Our total liability is limited to the amount paid for the specific order.
7. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with Swiss Law. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of Geneva, Switzerland.
